Sales, Freight, and Warranty Terms and Conditions
Identification Only
Identification is required from all customers. Possession of 3D Safety Services Pty Ltd's product catalogue does not constitute the right to purchase from 3D Safety Services Pty Ltd.
Prices
All prices offered are customer specific prices with discounts already deducted. Market Sensitive Commodity items will be displayed as Price On Application (P.O.A), according to current market conditions.
Goods and Services Tax
3D Safety Services Pty Ltd is required to charge applicable goods and services tax (GST) on every service and item.
Payment Terms
For customers with established credit, terms are net thirty (30) days from date of shipment. At 3D Safety Services Pty Ltd's option, export orders may be subject to special export payment terms and conditions. If credit is not established, please include payment with order through Visa, MasterCard, or American Express. Cash or anticipation discounts are not allowed. All payments must be in AUS dollars. 3D Safety Services Pty Ltd shall have the right of off-set and deduction for any sums owed. If customer fails to make payment within thirty (30) days, 3D Safety Services Pty Ltd may defer shipments until such payment is made, or may, at its option, cancel all or any part of the unshipped order.
Credit Balance
The Customer agrees that any credit balances issued will be applied within one (1) year of its issuance.
IF NOT APPLIED OR REQUESTED WITHIN ONE (1) YEAR, ANY BALANCE REMAINING WILL BE SUBJECT TO CANCELLATION, AND 3D SAFETY SERVICES
PTY LTD® SHALL HAVE NO FURTHER LIABILITY.
Export Sales, Freight, and Warranty Terms and Conditions
Our Carrier
3D Safety Services Pty Ltd will utilise our own contracted transport company, unless otherwise stipulated by the purchaser. Property of these goods are transferred to the purchaser on delivery.
Your Carrier
3D Safety Services Pty Ltd will at the request of the purchaser, transport goods via their nominated carrier. Property of these goods are transferred to the purchaser at the time of despatch and all proof of deliveries (POD) or goods lost in transit are the responsibility of the purchaser.
Rates
All rates are subject to variation from time to time unless otherwise agreed to under the terms of a separate contract.
Insured Freight
Some products flagged in the Online Catalogue are of a particularly high value and will be insured for its transportation. Normal road carriers will not insure individual consignments, therefore if these products are ordered with other general freight items, you may receive two consignments. Freight costs on these products are subject to individual quotations.
Prompt Decision
3D Safety Services Pty Ltd will make a good faith effort for prompt correction or other adjustment with respect to any product, which proves to be defective within warranty period. Before returning any product, write or call the 3D Safety Services Pty Ltd branch from which the product was purchased, giving date and number of original invoice, and describing defect.
OHS Hazardous Substance
Material Safety Data Sheets (MSDS) for OHS defined hazardous substances and a list of products known by the state of New South Wales to cause cancer or reproductive harm are available at your local 3D Safety Services Pty Ltd branch, or by contacting 3D Safety Services Pty Ltd, support@3dss.com.au. The information and recommendations contained on the MSDS supplied by the manufacturer is considered to be accurate and reliable. 3D Safety Services Pty Ltd, however, makes no warranty with respect to the accuracy of the information or the suitability of the recommendations. 3D Safety Services Pty Ltd disclaims any and all liability to any user.
Additional Terms
Cancellation
Any cancellation must be approved by 3D Safety Services Pty Ltd, and may be subject to restocking and other charges.
Electronic Data Interchange
If 3D Safety Services Pty Ltd and customer have mutually agreed to use an Electronic Data Interchange (EDI) system to facilitate purchase and sale transactions, customer agrees: that it will not contest (i) any contract of sale resulting from an EDI transaction under the provisions of any law relating to whether agreements must be in writing or signed by the party to be bound thereby. 3D Safety Services Pty Ltd and customer will negotiate and agree on technical standards and methods to use in making EDI purchases, and will use proper security procedures to protect EDI records from improper access. The business records maintained by 3D Safety Services Pty Ltd regarding EDI purchases made by customer shall be controlling.
Modification of Terms
3D Safety Services Pty Ltd's acceptance of any order is subject to customer's assent to all of the terms and conditions set forth in 3D Safety Services Pty Ltd's acknowledgment, and customer's assent to these terms and conditions shall be presumed from customer's receipt of 3D Safety Services Pty Ltd's acknowledgment, or from customer's acceptance of all or any part of the goods or services ordered. No addition or modification of terms and conditions shall be binding upon 3D Safety Services Pty Ltd unless agreed to by 3D Safety Services Pty Ltd in writing. If a purchase order or other correspondence contains terms or conditions contrary to the terms and conditions contained in 3D Safety Services Pty Ltd's acknowledgment, 3D Safety Services Pty Ltd's acceptance of any order shall not be construed as assent to any additional terms and conditions, nor will that constitute a waiver by 3D Safety Services Pty Ltd of any of the terms and conditions contained in S3D Safety Services Pty Ltd's acknowledgment.
Complete Agreement
The terms and conditions in 3D Safety Services Pty Ltd's forms, acknowledgments, quotations, invoices, websites, and catalogue sales terms and conditions are incorporated herein by reference, and constitute the entire and exclusive agreement between customer and 3D Safety Services Pty Ltd.
Waiver, Choice of Law and Venue
The failure of either party to assert a right hereunder or to insist upon compliance with any term or condition will not constitute a waiver of that right or excuse any subsequent nonperformance of any such term or condition by the other party. All transactions shall be governed by the courts of New South Wales and any courts that have jurisdiction to hear appeals from any of those courts, and venue shall be in Sydney, New South Wales.
No Third Party Benefit
Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of New South Wales and any courts that have jurisdiction to hear appeals from any of those courts and waives any right to object to any proceedings being brought in those courts.
Occupational Health and Safety (OHS) Policy
The management and staff undertake to provide a safe work environment for all employees, contractors and visitors. We will achieve this by:
- Committing to and maintaining a documented management system that clearly identify roles and responsibilities and accountability for preventing workplace injuries
- Systematically reviewing the management system as to its effectiveness in achieving the company’s requirements
- Scheduling meetings that will provide the forum for employees and managers to freely express their views on safety issues
- Maintaining a document control register that will establish the integrity of the management system conducting workplace inspections that will identify all activities, products and processes that are hazardous or have risks associated with them and record their management appropriately
- Ensuring resources are made available to provide training and appropriate safety equipment for all employees as identified in the workplace inspections
- Monitoring prevention of further injury and/or management of injury through our Return To Work Policy
- Consulting with suppliers and contractors to ensure their commitment to our system
- Complying with all relevant legal criteria and obligations
- All employees must recognise that they have a responsibility to actively promote safety in the workplace by adhering to the safety policy
- All management accepts the responsibility for health and safety of persons under their control
Quality Policy Statement
The Management and Staff of 3D Safety Services Pty Ltd strive for continuous improvement in the delivery of the services and products provided to clients of the Company.
- Services provided will be delivered through properly qualified and certified trainers and inspectors.
- Products supplied will where possible be sourced from internationally accredited organisations to ensure that the quality and integrity of the product is maintained.
- The effective implementation of the Quality Management System ensures that control measures are reviewed and improved as part of our continuous improvement program.
- Accreditation to ISO 9001:2000 is maintained through independent third party auditing by Quality Assurance Services Pty Ltd.
- Quality Management methodology is applied to all facets of the company so that traceability and compliance to state and federal regulations is ensured at all times.
- Our Quality Management System is available for evaluation by clients of the company.
- Maintenance of the Quality Management System cannot be achieved without the active participation of all the management and staff of the company.
- Support of the Quality Management System is a mandatory requirement of the employee contract entered into by each member of the company.
